The granting of a special status to the North West and South West Regions, pursuant to Article 62 paragraph 2 of the Constitution which provides that: The law may take into account the specificities of certain regions in their organization and operation.
The allocation of a special allocation to each of the North West and South West communes, intended to facilitate the start of activities
The effective implementation of the regions as soon as possible
The abolition of the status of delegate of the appointed government, provided for under the special regime applicable to certain agglomerations
The substantial reduction of the supervision applicable to decentralized territorial collectivities
With a view to strengthening the financial autonomy of local and regional authorities, proceed to:
- the effective implementation of Article 23, paragraph 2 of the 2004 Decentralization Orientation Law, which stipulates that the fixed budget law each year, on the proposal of the government, the fraction of the receipts of the State, allocated to the general endowment of the decentralization. In this respect, the proposed revenue fraction was estimated by the participants in a range of 10 to 15%.
- The easing of uniqueness rules that delay the provision of resources to local and regional authorities.
The revision with a view to adapting them to the new context, the decentralization laws of July 22, 2004, as well as those of 2009 on local taxation and the financial system of decentralized territorial communities.
To increase the administrative and management autonomy of the decentralized territorial collectivities, it is important to:
- Create a local civil service as specified in Article 19 of the decentralization law of 2004
- Closely involve municipal magistrates in the appointment of the general secretaries of municipalities and municipal receivers
- Determine the modalities of co-operation between the decentralized territorial collectivities and the deconcentrated services of the State.
- Revise land and tenure systems with a view to involving decentralized territorial communities in land management.
Finally, the participants stressed the need for the establishment of a road map, a chronogram and a body for monitoring the implementation of the above recommendations.
